Affiliate Programme Terms & Conditions

Welcome to the Cosmos Healing Affiliate Programme.

These Affiliate Programme Terms & Conditions (“Terms”) govern participation in the Cosmos Healing Affiliate Programme (“Programme”) operated by Cosmos Healing (“Cosmos Healing”, “we”, “us” or “our”).

By applying to join the Programme, confirming your agreement to these Terms during the application process, and participating in the Programme, you (“Affiliate”, “you” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, you should not apply to or participate in the Programme.

1. Our approach to partnership

The Cosmos Healing Affiliate Programme is intended for wellness practitioners, professionals and creators who feel genuinely connected to our products and approach.

We value authentic, responsible sharing rooted in genuine experience rather than scripted promotion.

Participation in the Programme does not create an employment, agency, franchise, partnership or joint venture relationship between you and Cosmos Healing.

Affiliates act independently and may not represent themselves as employees, agents or authorised representatives of Cosmos Healing.

2. Application and acceptance

All applications are subject to review and approval by Cosmos Healing.

Submitting an application does not guarantee acceptance into the Programme. We reserve the right to approve, decline or defer an application at our discretion.

Approved Affiliates will receive access to their affiliate benefits through Shopify Collabs, including a unique affiliate link and/or discount code.

3. Affiliate commission

Approved Affiliates currently earn 10% commission on qualifying sales of eligible products included in their Cosmos Healing Affiliate Programme offer.

Commission is calculated by Shopify Collabs based on the eligible value of the qualifying sale, in accordance with the Programme settings and Shopify Collabs' applicable calculation rules.

The eligible products and applicable commission rate are displayed in the Affiliate's Shopify Collabs offer and may be updated from time to time.

Commission is earned only on qualifying sales successfully attributed to the Affiliate through Shopify Collabs.

Commission is not payable on shipping charges, fully refunded or cancelled orders, fraudulent transactions, self-referrals or other transactions deemed ineligible under these Terms or the applicable Shopify Collabs rules.

4. Customer discount

Your community currently receives 10% off eligible products when purchasing through your unique affiliate link or using your affiliate discount code.

The customer discount:

applies only to products included in the applicable affiliate offer;
is currently limited to one use per customer; and
may be subject to Shopify checkout rules and other discount restrictions.

Affiliate discounts may not necessarily be combined with other promotions, offers or discount codes.

Cosmos Healing reserves the right to change eligible products, discount rates or discount conditions in accordance with Section 14 of these Terms.

5. Affiliate links, codes and attribution

Your personalised affiliate link and discount code are provided through Shopify Collabs.

You are responsible for using the correct affiliate link or discount code when referring customers to Cosmos Healing.

Our current affiliate attribution window is 30 days. Where a qualifying customer purchase is successfully attributed to your affiliate link or code within the applicable attribution period, Shopify Collabs will record the commission according to its tracking system.

Cosmos Healing cannot guarantee attribution where tracking is prevented or disrupted, including where a customer clears cookies, changes devices or browsers, blocks tracking technologies, or otherwise prevents Shopify Collabs from attributing the transaction.

We cannot retrospectively attribute a purchase or commission merely because a customer later advises us that they were referred by an Affiliate.

6. Commission holding period and payments

Affiliate commissions are tracked and administered through Shopify Collabs.

Cosmos Healing currently operates a 30-day commission holding period. This allows time for refunds, cancellations, disputes or other adjustments before an eligible commission becomes payable.

Following the holding period, eligible commissions are processed through Shopify Collabs in accordance with Shopify's applicable payout processes and requirements.

Affiliates are responsible for maintaining the account and payout information required by Shopify Collabs to receive payment. Cosmos Healing is not responsible for delays or failures arising from incomplete or inaccurate Affiliate account or payout information, or from circumstances within Shopify's payment systems.

7. Refunds, cancellations and disputes

No commission is payable on an order that is fully refunded or cancelled during the applicable holding period.

Where a transaction appears fraudulent, suspicious, improperly attributed or otherwise inconsistent with these Terms, Cosmos Healing may dispute, withhold or cancel the applicable commission where permitted through Shopify Collabs.

Shopify may independently review, hold or otherwise take action in relation to transactions or accounts in accordance with its applicable rules and policies.

8. Self-referrals and misuse

The Affiliate Programme is intended to reward genuine referrals.

Affiliates may not use their own affiliate link or discount code to generate commission on their own purchases.

You may not:

create false, duplicate or misleading transactions;
encourage another person to make a purchase on your behalf for the purpose of generating commission;
manipulate Shopify Collabs tracking or attribution;
distribute your discount code through unauthorised coupon, voucher or discount-code websites;
use paid advertising that falsely appears to originate from Cosmos Healing;
engage in cookie stuffing, misleading redirects, spam or other deceptive affiliate practices.

Commission arising from suspected misuse may be disputed, withheld or cancelled where permitted by Shopify Collabs, and your participation in the Programme may be terminated.

9. Responsible representation and health claims

This section is particularly important to us.

Cosmos Healing products should be shared responsibly, accurately and in a manner consistent with the information provided by Cosmos Healing.

Affiliates must not:

make false, misleading or unsubstantiated claims about Cosmos Healing or its products;
state or imply that a product is guaranteed to diagnose, treat, prevent or cure a disease or medical condition;
guarantee particular health outcomes or results;
provide information about our products that materially contradicts Cosmos Healing's published product information, instructions or safety guidance;
present personal experience or opinion as established medical fact;
encourage inappropriate or unsafe use of a product; or
claim to speak on behalf of Cosmos Healing unless expressly authorised to do so.

Where you share your own experience, it should be clear that it is your personal experience and that individual experiences and outcomes may vary.

Affiliates who work professionally in health or wellness remain responsible for operating within their own qualifications, professional scope and applicable legal or regulatory obligations.

10. Authenticity and disclosure

We encourage Affiliates to share Cosmos Healing products in their own voice. We do not require scripted promotion.

However, your relationship with Cosmos Healing must be disclosed clearly and appropriately whenever required by applicable advertising, consumer-protection or social-media rules.

You are responsible for ensuring that your affiliate content complies with the laws, advertising standards and disclosure requirements applicable to you and your audience.

11. Intellectual property and content

Cosmos Healing retains all rights in its trademarks, logos, photographs, product imagery, written material, educational content and other intellectual property.

Approved Affiliates may use brand assets expressly supplied or made available by Cosmos Healing for the purpose of promoting eligible products during their participation in the Programme.

Brand assets may not be materially altered, misrepresented, sold, sublicensed or used in a way that could reasonably damage the Cosmos Healing brand.

Unless otherwise agreed, participation in the Programme does not transfer ownership of either party's intellectual property to the other.

If Cosmos Healing wishes to reproduce Affiliate-created content beyond functionality inherently provided through social-media sharing or Shopify Collabs, we will seek appropriate permission where required.

12. Conduct and brand alignment

Affiliates are expected to communicate respectfully and responsibly when representing or referring to Cosmos Healing.

We reserve the right to end a partnership where an Affiliate's conduct, promotional practices or public representation of Cosmos Healing is materially inconsistent with our values, damages or is reasonably likely to damage our reputation, or creates legal, regulatory or safety concerns.

13. Termination

Either party may end the affiliate relationship at any time.

Cosmos Healing may suspend or terminate participation immediately in cases including:

false or misleading promotion;
prohibited health claims;
fraudulent or self-referred transactions;
misuse of affiliate links or discount codes;
infringement of intellectual property;
unlawful activity;
abusive or inappropriate conduct;
breach of these Terms; or
material conduct likely to harm Cosmos Healing or its community.

When an affiliate relationship ends, affiliate links and discount codes may be deactivated and no further commission will accrue.

Valid commission already earned before termination will be handled in accordance with Shopify Collabs' applicable payment processes and these Terms.

14. Changes to the Programme or these Terms

Cosmos Healing may amend these Terms or make reasonable changes to the Programme, including commission rates, customer discounts, eligible products, attribution periods or other Programme conditions.

Where a change materially affects an Affiliate's participation in the Programme, we will provide reasonable notice before the change takes effect where practicable.

Continued participation in the Programme after the effective date of the notified change will constitute acceptance of the updated Terms. If you do not agree to a change, you may discontinue participation in the Programme.

15. Limitation of liability

While we take reasonable care in administering the Programme, affiliate tracking and payment infrastructure is provided in part by Shopify Collabs and other third-party systems.

To the extent permitted by applicable law, Cosmos Healing will not be liable for indirect or consequential loss arising from tracking failures, platform outages, technical errors, unavailable services or circumstances reasonably outside our control.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.

16. Taxes and independent obligations

Affiliates are responsible for determining and meeting their own tax, reporting, business-registration and other legal obligations arising from affiliate income.

Each party remains responsible for its own applicable tax obligations, subject to any taxes collected, withheld or remitted through Shopify or another applicable payment system.

17. Governing law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute arising from or relating to these Terms or participation in the Programme will be subject to the jurisdiction of the courts of South Africa, subject to any rights that cannot lawfully be excluded.
